Nedenstående ordre fra øverstbefalende General-Major Moshe Kaplinski fra den israelske hær (IDF) er bevis på at Israel nu reelt er ved at annektere palæstinensisk jord på Vestbredden. Jord, der falder udenfor Apartheid-murens linje, bliver forbudt område for palæstinensere uden særlig tilladelse. En tilladelse de mange palæstinensiske landmænd, hvis jorder ligger på “den forkerte side” – mellem muren og Den grønne Linje – ingen garanti har for at få. De mange palæstinensere som ikke bare har jord, men også bor i områderne er med ét slag blevet dømt for “ulovligt ophold”.
Hidtil har staten Israel påstået at opførelsen af Apartheid-muren ikke skulle føre til annektering. Imidlertid har Israel gjort det praktisk taget umuligt for palæstinenserne at dyrke deres tusinder af hektar landbrugsjord. Forhindres palæstinenserne i at vedligeholde marker og plantager, bl.a. pga. de hyppige udgangsforbud, Apartheid-muren og nu denne særlov, kan staten iflg. israelsk lov inddrage jorden pga. misligeholdelse. En yderst udbredt praksis i statens historie.

ISRAEL SEQUESTERS PALESTINIAN FARMLAND WEST OF WALL
Kicks farmers out of their orchards, claiming land is „Israel”
[Occupied West Bank] Contrary to what the Israeli establishment has been saying, the government of Ariel Sharon has made another big land grab. A new order issued by the military commander of the West Bank announced to Palestinians that they are no longer allowed to be on their land west of the separation wall. The order, which was distributed in Hebrew and illegible Arabic last week, states that the land west of the wall is a closed military area and that only Israelis, those eligible to be Israelis under the Law of Return (i.e. practically every Jew in the world) or those issued special permits would be allowed to be on the land. The military order announcing the new restrictions, signed by Major General Moshe Kaplinski, the commander of IDF forces in “Judea and Samaria”, and dated October 2, 2003, declares that lands west of the barrier are closed military zones and farmers who want access need to apply for a „long-term residency” permit. Palestinians also found at least two accompanying orders, signed by Brigadier General Ilan Paz, the head of the civil administration, and dated October 7, 2003. These orders detail how Palestinians are supposed to go about applying for the appropriate permits to be on their land west of the wall.
Of course, nothing in the order guarantees that permits will be granted to these Palestinian landowners, nor even respected if granted.
The idea of applying for a permit to be on one’s own land is rejected by Palestinians who have been on these lands for generations. In addition to the thousands of dunams of farmland, water wells, and greenhouses that are being isolated from their owners, thousands of Palestinians reside in 15 villages that fall between the wall and the Green Line. According to this new order, these Palestinians are „illegally” residing in their homes now.
In building the Separation Wall, the Israeli government has insisted that it is not confiscating more Palestinian land and has argued against the negative impact of this wall on Palestinians by claiming that farmers with land falling on the other side (west of the wall) will have access points/openings that they can pass through into their farmlands. Since the concrete walls have been built and the fences erected, a small number of gates have been built into the barricade and a prison-like system of access to orchards for farmers implemented.
Due to the random open/close schedule of the gates, however, and the harassment faced by farmers attempting to pass daily, dozens of farmers in Jayyous [Qalqilya region] had taken to camping out on their land to ensure that they could tend to their fields, while other farmers faced up to the abuse and daily attempted, sometimes successfully, sometimes not, to reach their fields. For the farmers that have been camping out on their land, ISM volunteers have been helping with the delivery of food to them from the village, passing bread, water and some home-cooked meals through the barbed wire to the farmers on the other side.
On Friday October 3 the gate was not opened at all for the farmers of Jayyous and Palestinians throughout the West Bank. The gates have remained totally closed since.
On Monday, October 13, 2003, in Jayyous, over 30 of the farmers who were camping on their land were rounded up, their IDs confiscated and told that they could no longer be on the land, because the land was „now Israel”. A 17-year-old boy, Nael Zaher Nofel, who was riding his bike near Jayyous‚ west gate was abducted by Israeli soldiers yesterday and has yet to be released.
As opposed to Israeli government claims that the wall is a security messure, this military order is seen by Palestinians as another political move, part of a political initiative: the Seperation Wall, in Israel’s overall political plan to remove them from the area, taking their land. According to Israeli State Law, land that is neglected for 3 years or more can be siezed for state use. Making it almost impossible for Palestinians to be on their land ensures long-term neglect and thus „legalized” confiscation of the land by the Israeli State. Soldiers enforcing this new order have already called it for what it is: „this land is now Israel” an Israeli soldier screamed at a Palestinian farmer in Jayyous as he forced him off his land yesterday.

Translation of Israeli military order
ISRAEL DEFENCE FORCES
An order concerning security commands (Judea and Samaria) (no. 378) – 1970 A
Declaration concerning the closure of area no. s/2/03/ (Seam area)
Under my authority as the commander of the IDF forces in the Judea and Samaria region and according to articles 88 and 90 to the Order Concerning Security Commands (Judea and Samaria) (no. 378) – 1970 (“The Order”) and due to
the special security circumstances in the area and the need to take necessary steps to prevent terror attacks and prevent terrorists from leaving the territories of the Judea and Samaria area and entering the State of Israel, I hereby declare the following:
Definitions:
1. In this declaration:
“The Map” – a map in 1:150,000 scale, titled: “A Declaration concerning the closure of area s/02/03/ (Seam area)”, which is signed by me and constitutes an integral part of this declaration.
“Israeli” – any of the following:
A. A citizen of the State of Israel.
B. A resident of the State of Israel, who is registered in Israel’s population registry according to the law of population registry – 1965.
C. Whoever is entitled to immigrate to Israel according to the Law of Return – 1950.
“The Obstacle” – fences, walls and patrol roads, which are intended to prevent terror attacks and prevent terrorists from leaving the territories of the Judea and Samaria area and entering the State of Israel, which were constructed according to the seizing orders which are detailed in section A of the Appendix to this declaration.
“Seam area” – Any area which is delimited by the obstacle, which is marked on the map by a red line, at the direction of the State of Israel.
Closure of an Area
2. I hereby declare that “Seam area” is a closed area.
Restriction of entrance and presence
3. A. No person will enter the Seam Area nor be present there.
B. A person who is present in the Seam Area must leave it immediately.
A Limit to the applicability:
4. A. Article 3 of this declaration would not apply to:
1. An Israeli.
2. Whoever was given a permit by me or anyone authorized by me to enter The Seam Area and to stay there, all according to the conditions detailed in the permit. A permit, according to this paragraph, could be general, personal or special.
B. Despite what is stated in article 4(A), a military commander is entitled to determine that article 3 in this declaration would apply to a person or to any type of people who enter The Seam Area or stay there.
Permanent Residents
5. A. A person, who is at least 16 years of age, whose permanent residence on the day this declaration comes into effect is in the Seam Area would be allowed to enter the Seam Area and stay there as long as he holds a written permit, given to him by me or anyone authorized by me, which testifies that his permanent residence is in the Seam Area, all according to the conditions detailed in the permit.
B. 1. A person who is not yet 16 years old, whose permanent residence is in the Seam Area would be allowed to enter the Seam Area, without a written permit, as stated in article 5(A).
2. A person who is not yet 16 years old, whose permanent residence is The Seam Area, would be allowed to enter the Seam Area in one of the following ways:
a. If he has a written permit, as stated in article 5(A), as long as he is at least 12 years old.
b. Accompanied by a person whose entrance was authorized according to article 5(A).
c. In any other way determined by me or anyone authorized by me.
Passages
6. A. Entering The Seam Area and leaving it would be done through the passages detailed in Part B of the Appendix to this declaration, which are marked in blue on the map, all according to the conditions determined by me or anyone authorized by me.
B. In this article:
“Entering the Seam Area” – Entering the Seam Area from the direction of the region’s territories which are not in The Seam Area.
“Leaving the Seam Area” – Leaving the Seam Area at the direction of the region’s territories which are not in the Seam Area.
Authorization
7. The head of the civil administration is authorized to determine orders and regulations in every issue concerning this declaration.
Publication
8. A. Copies of this declaration and of the map attached to it would be available for any person to examine during the regular working hours ofthe following offices:
1. The regional District Coordinating Offices (DCOs).
2. The police stations in the Judea and Samaria region.
3. The bureau of the legal advisor in the Judea and Samaria region.
4. The offices of the Head of Infrastructure in the Civil Administration in the Judea and Samaria region.
B. Copies of this declaration and the map attached to it will be hung on the announcement boards in the offices of the DCO, as stated in article 8(A1), for a period of 3 months from the day the signing of this declaration was published.
C. The head of the civil administration is entitled to determine other methods of publications, beyond those detailed in articles 8(A) and 8(B).
Preservation of Laws
9. Nothing in this declaration can undermine the validity of declarations concerning the closure of an area or other commands which apply to The Seam Area.
Order Start Date
10. This declaration goes into effect on the day of its signing.
The Name
11. This declaration would be called: “A Declaration Concerning the closure of area no. s/2/03 (the Seam Area) (Judea and Samaria) – 2003.
